Terms of Service
Welcome to Auckland Pickleball Centre (“APC”, “we”, “our”, “us”). These Terms of Service govern your access to and use of our website, booking platform, memberships, lessons, events, and facilities. By accessing our website, creating an account, making a booking, purchasing a membership, or entering the facility, you agree to these Terms.
1. Eligibility & Supervision
The minimum age to play pickleball at APC is 10 years old. Children under 10 years of age are not permitted to play, unless expressly authorised by APC management.
Anyone under 17 years of age must be accompanied by a responsible adult at all times. APC is not a childcare or community supervision facility. Children are never permitted to be unattended anywhere on the premises, including courts, spectator areas, or common spaces. Failure to comply may result in removal from the facility without refund.
2. Services Provided
APC provides:
- Pickleball court bookings
- Memberships
- Open play sessions
- Events, lessons, and related services
- Access to physical facilities and digital platforms (including CourtReserve)
Services are subject to availability and may change from time to time.
3. Accounts & Bookings
- Users must provide accurate and current information when creating an account.
- All court bookings must be made through APC’s official booking system (CourtReserve).
- Bookings are confirmed only once payment has been successfully processed (where applicable).
- Each booking applies only to the specific court and time slot booked.
- Extensions or additional time require a separate booking and are subject to availability.
Member Daily Court Access
- Members are entitled to a maximum of one (1) hour of complimentary court time per day, subject to availability and first-in, first-served principles.
- Court bookings beyond the complimentary one-hour allocation must be purchased at the applicable rate.
APC reserves the right to modify or cancel bookings for operational, safety, maintenance, compliance, or facility requirements.
4. Payments
- Prices are displayed in New Zealand Dollars (NZD) and include GST where applicable.
- Payments are processed through secure third-party providers.
- APC does not store full credit or debit card details.
- Failed or declined payments may result in suspended access to services.
5. Cancellations & Refunds
General Rules
- All cancellations must be made through CourtReserve.
- Refund eligibility depends on the booking type, the time of cancellation, and the value of the booking.
- No-shows are non-refundable.
Court Reservations
- Cancellations made more than 12 hours before the booking start time may be eligible for a refund.
- Automatic refunds apply to bookings $70 or less.
- Refunds over $70 require manual approval.
- No refunds for cancellations within 12 hours of the booking start time.
Lessons & Coaching Sessions
- Cancellations made more than 12 hours in advance may be eligible for a refund.
- Automatic refunds apply to bookings $250 or less.
- Refunds over $250 require manual approval.
- Late cancellations and no-shows are non-refundable, except at APC’s discretion.
Drop-In Events
- Cancellations made more than 12 hours before the event start time may be eligible for a refund.
- Automatic refunds apply to bookings $70 or less.
- Refunds over $70 require manual approval.
- No refunds within 12 hours of the event start time or for no-shows.
Full Events / Multi-Day Events
- Cancellations made more than 12 hours before the first scheduled event date may be eligible for a refund.
- Automatic refunds apply to bookings $250 or less.
- Refunds over $250 require manual approval.
- Partial attendance, late cancellations, or no-shows are non-refundable.
Refund Processing
- Refunds are issued to the original payment method or as APC account credit, at APC’s discretion.
- Processing times vary depending on the payment provider.
- APC may refuse refunds where repeated cancellations or misuse are identified.
Membership fees are generally non-refundable except where required by law.
6. Memberships
- Membership benefits vary by tier and are subject to published rules.
- All memberships, billing, holds, cancellations, and refunds are managed exclusively through CourtReserve.
- Verbal, social media, or informal requests are not valid unless submitted in writing and approved by APC management.
Any included free court time is:
- Limited to 1 hour per day
- First-in, first-served
- Subject to availability
Additional court time must be booked and paid. Memberships may be suspended or terminated for breach of these Terms.
7. Membership Holds / Suspensions
Eligibility
Membership holds may be considered only for:
- Medical reasons (supporting documentation required)
- Exceptional personal circumstances (at APC management discretion)
Extended travel is not an accepted reason for membership holds.
Conditions
- Requests must be submitted at least 7 days in advance.
- Minimum hold period (where approved): 3 months.
- Maximum hold period: 6 months per rolling 12-month period.
- Holds are not automatic and require written approval by APC.
Billing During Holds
- Monthly memberships: billing continues unless the hold is approved before the next billing date.
- Fixed-term memberships: approved hold time may extend the membership end date at APC’s discretion.
Access During Holds
While on hold, members cannot book courts, cannot register for events or lessons, and do not receive member benefits.
8. Membership Cancellations
Monthly Memberships
- Must be cancelled through the CourtReserve Member Portal.
- Require 30 days’ notice.
- Billing continues during the notice period.
- No refunds or credits for partial months.
6-Month & Annual Memberships
- Non-refundable once activated.
- Early cancellation does not generate refunds or credits.
- Membership remains active until the end of the purchased term.
9. No Refunds, Holds, or Credits Are Provided For
- Non-attendance or reduced usage
- Changes in personal schedule
- Forgetting to cancel
- Public holidays or weather
- Temporary injury without medical documentation
- Dissatisfaction with opponents, sessions, or style of play
10. Facility Rules & Conduct
- Courts are for pickleball play only unless approved otherwise by APC.
- Non-marking court shoes must be worn at all times.
- Food and drink (other than water) are not permitted on courts.
- Follow posted rules and staff instructions, and use facilities only for approved purposes.
- Behave respectfully toward staff and other users.
- Members booking courts are responsible for ensuring all participants comply with APC rules and etiquette.
Respectful behaviour is mandatory. Abusive, unsafe, or disruptive conduct may result in immediate removal, suspension, or cancellation of bookings or memberships without refund. APC may refuse entry or remove any person for unsafe, disruptive, or inappropriate behaviour.
11. Guests & Visitors
- Members may book courts for themselves and their guests.
- Guests must pay the applicable visitor fee unless otherwise stated.
- The booking member is responsible for the conduct of their guests.
12. Equipment
- Nets and posts are provided and must not be moved without staff approval.
- Paddle and ball hire may be available.
- All equipment must be used appropriately and returned in good condition.
13. Health, Safety & Assumption of Risk
Assumption of Risk
Pickleball involves inherent risks, including but not limited to:
- Slips, trips, and falls
- Collisions with players or equipment
- Muscle strains or overuse injuries
- Equipment failure
Participation is entirely at your own risk.
Health Responsibility
You confirm that you are physically capable of participation and accept responsibility for monitoring your own health.
Liability
To the fullest extent permitted by New Zealand law, APC is not liable for injury, loss, or damage arising from participation or use of the facilities. APC is not liable for loss, theft, or damage to personal property.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
14. Photography & Media
APC may capture photos or videos within the facility for promotional or operational purposes. By using APC services, you consent to reasonable use of such imagery unless you opt out in writing.
15. Intellectual Property
All website content, branding, logos, and materials are owned by APC and may not be copied, reproduced, or used without permission.
16. Privacy
Use of APC services is subject to our Privacy Policy, which explains how personal information is collected, used, and protected in accordance with the New Zealand Privacy Act 2020.
17. Limitation of Liability
To the maximum extent permitted by law:
- APC excludes liability for indirect or consequential loss.
- APC’s liability is limited to the value of services paid for.
Nothing in these Terms limits rights under the Consumer Guarantees Act 1993.
18. Changes to These Terms
APC may update these Terms of Service at any time. Continued use of our services constitutes acceptance of the updated Terms.
19. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of New Zealand courts.
20. Final Authority
All decisions relating to bookings, refunds, holds, memberships, and facility use are subject to APC management approval. CourtReserve system records are final.
